
For most of the past three years, organizations treated vendor AI risk as a procurement question. Does this tool do what it claims? Is the vendor reputable? Does the contract have reasonable data handling terms?
That framing is no longer sufficient. In 2026, vendor AI risk has become organizational risk in a way that changes what compliance programs are expected to do about it.
Lawsuits against AI vendors including Workday and Eightfold AI have raised direct questions about who is accountable when an AI system produces a biased or discriminatory outcome. The answer regulators and courts are converging on is that the organization that deployed the tool shares that accountability, regardless of who built it.
At the same time, regulators are explicitly extending their expectations into the vendor relationship. The GSE mortgage requirements that took effect in early 2026 apply to vendor tools used for fraud detection, document processing, and customer communications, not just underwriting models. The SEC is examining how financial institutions manage third-party AI risk. ISO 42001 and NIST AI RMF both treat vendor oversight as a core governance requirement, not an optional add-on.
The procurement conversation has shifted. It is no longer just about whether a tool increases efficiency. It is about whether a tool can withstand scrutiny if challenged.
Where the Accountability Gap Lives
Most organizations have a vendor management process. Most of those processes were not built with AI in mind.
A standard vendor review covers contractual terms, security posture, and business continuity. It does not typically ask what data the vendor's AI model was trained on, what the model's error rates are across different demographic groups, what happens to your data when the vendor uses it to improve their model, or whether the vendor can provide documentation of their AI governance practices on request.
That gap matters because regulators and courts are not distinguishing between the AI your team built and the AI your team bought. If you deployed it, you are expected to have evaluated it, monitored it, and be able to explain the basis on which you determined it was appropriate for the decisions it influences.
Most organizations cannot do that for the majority of their vendor AI footprint. And most do not have an accurate picture of how large that footprint actually is.
What Regulators Are Now Requiring
The clearest articulation of vendor AI expectations is in the financial services sector, but the direction applies broadly.
The OCC's model risk management guidance — issued for credit models but increasingly applied to AI systems across operations — requires that third-party models receive the same validation rigor as internally developed ones. You cannot outsource model risk by outsourcing the model.
Fannie Mae and Freddie Mac's 2026 AI governance requirements explicitly include vendor tools in scope. Servicers are required to document the AI systems their vendors use in loan servicing, collections, and customer communications, maintain oversight of those systems, and demonstrate governance over outcomes even where the underlying model is proprietary.
The EU AI Act, which applies to any organization deploying AI that affects EU persons regardless of where the organization is headquartered, places direct obligations on deployers of high-risk AI systems. Vendor-supplied systems are not exempt. If the tool makes or influences a consequential decision, the deploying organization bears compliance responsibility.
What this adds up to is a set of expectations that most vendor management programs are not structured to meet. The question is no longer just whether you vetted the vendor. It is whether you can demonstrate ongoing oversight of the AI the vendor is running on your behalf.
The Questions Your Vendor Management Process Is Not Asking
Bringing vendor AI into scope requires adding a layer of AI-specific diligence to the vendor review process. The questions that matter are different from standard procurement questions.
On the model itself: What data was the model trained on, and does the vendor permit independent validation? What are the model's known limitations, and what populations or use cases has it been tested against? Has the model been audited for disparate impact, and can the vendor share those results?
On your data: Does the vendor use customer or organizational data to retrain or improve the model? If so, under what terms, and what opt-out rights do you have? Where is inference data processed and stored, and who has access to it?
On governance: Does the vendor have a documented AI governance program? Who is responsible for the model internally at the vendor? What is the process for reporting errors, bias findings, or model changes that affect outcomes?
On continuity: If the vendor changes the model, how much notice do you receive? What is your recourse if the updated model produces different outcomes than what you evaluated? How do you re-validate after a model update?
Most vendors will not answer all of these questions satisfactorily. That is useful information. It tells you which parts of your vendor AI footprint carry the most unquantified risk, and where your oversight processes need to compensate for vendor opacity.
Building Vendor AI Oversight Into Your Program
The organizations that are ahead of this issue have done three things their peers have not.
They know what vendor AI they have. Not a list of approved software vendors, but a specific inventory of AI capabilities — including AI features embedded in platforms that were not purchased as AI tools. The HR platform with a candidate screening algorithm. The CRM with AI-generated lead scoring. The customer service platform with AI-generated response suggestions. All of it is in scope.
They have extended their risk classification process to cover vendor AI. High-risk vendor AI — systems that influence employment decisions, credit decisions, clinical decisions, or customer communications in regulated industries — receives the same risk documentation requirements as internally developed high-risk systems. That includes a documented rationale for deployment, a bias and fairness assessment, a monitoring cadence, and a named internal owner.
They have added AI-specific terms to vendor contracts. The right to audit, notification requirements for model changes, restrictions on use of organizational data for model training, representations about validation and bias testing, and defined processes for reporting errors or adverse outcomes. These terms are increasingly available from vendors who have anticipated the regulatory direction. Vendors that resist them are a signal worth noting.
What Happens When You Cannot Answer the Questions
The exposure from inadequate vendor AI oversight is no longer theoretical.
The Workday litigation established that employers can be named in bias claims arising from AI-assisted hiring decisions, even where the AI was purchased, not built. EEOC guidance on AI in employment has made clear that the same adverse impact standards that apply to human screening processes apply to algorithmic ones. Reasonable due diligence is not a complete defense, but the absence of due diligence documentation makes a defense considerably harder to mount.
On the regulatory side, the cost of an examination finding related to vendor AI oversight is not just the remediation. It is the signal it sends about the maturity of your overall governance program. Examiners and auditors use individual findings to assess systemic risk. A vendor AI finding in one area creates scrutiny across your entire AI footprint.
The organizations that will handle the next wave of regulatory pressure well are the ones that treated vendor AI oversight as a core governance function before they were required to. That window is closing.
Where to Start
If your current vendor management process does not include AI-specific diligence, the starting point is an inventory. Map the AI capabilities in your existing vendor relationships before you redesign the process for new ones. You will almost certainly find more than you expect.
From there, prioritize by risk. Vendor AI that influences high-stakes decisions — employment, credit, clinical, collections, customer communications in regulated industries — gets addressed first. Vendor AI in lower-stakes applications can follow a lighter process, but it still needs to be documented and owned.
The goal is not a perfect vendor AI governance program on day one. The goal is a defensible program that demonstrates you understand what you have, you have evaluated the risk, and you are monitoring the outcomes. That is what regulators are asking for. It is also what the next round of litigation will require you to show.
