If you have been waiting for a clear federal AI compliance standard before building your governance program, 2026 is the year that strategy starts to fail.

Congress has not passed comprehensive AI legislation. The White House issued an executive order in late 2025 focused on AI preemption, but it created more questions than it answered. Meanwhile, state legislatures have moved forward on their own. Industry regulators have issued sector-specific requirements. And the gap between what your organization is doing with AI and what any regulator expects you to be able to demonstrate is closing faster than most compliance teams realize.

Here is where things stand and what it means for your program.

No Federal Standard, but Federal Pressure Is Real

The U.S. does not have a comprehensive federal AI law. What it does have is a growing body of agency guidance, examination priorities, and sector-specific requirements that are functionally creating compliance obligations whether or not Congress acts.

The SEC identified AI as a top examination priority for 2026, displacing cryptocurrency as the dominant technology risk concern. Examiners are looking at how financial institutions use AI internally, how they disclose AI use to clients, and how they manage vendor AI risk. Organizations that cannot answer those questions with documentation are exposed.

The Federal Trade Commission has been active on AI deception and what regulators are calling AI washing, where companies overstate the role or capability of AI in their products or services. This is not a hypothetical risk. Enforcement actions have followed.

For mortgage lenders and servicers, the pressure is immediate. Fannie Mae issued AI and machine learning governance standards in April 2026 with an August effective date. Freddie Mac's own requirements took effect in March. Both require documented AI inventories, designated governance owners, and audit-ready records covering not just underwriting models but vendor tools used across operations, fraud detection, and customer communications.

The States Are Not Waiting

In the absence of federal action, states have moved. The result is not a single standard. It is a patchwork of overlapping requirements with different thresholds, definitions, and enforcement mechanisms — and it is considerably harder to navigate than a single federal law would be.

Colorado's AI Act, the first state-level consumer protection statute focused specifically on AI, imposes obligations on developers and deployers of high-risk AI systems used in consequential decisions. Illinois has expanded its existing biometric data law to cover AI-generated representations. Texas enacted disclosure requirements for AI use in employment and financial services decisions.

California has been the most active. Multiple bills moving through Sacramento in 2026 address automated decision-making, algorithmic impact assessments, and generative AI disclosure requirements. Even where individual bills stall, the cumulative signal is clear: state regulators are not waiting for Washington.

For any organization operating across multiple states — which is most organizations — this means your governance program needs to be built for a multi-jurisdiction reality. A policy designed for one state's definition of "high-risk AI" will not hold up in another.

Sector Regulators Are Setting the De Facto Standard

The most immediate pressure for most compliance leaders is not coming from legislatures. It is coming from the regulators they already report to.

OCC guidance on model risk management, originally designed for credit models, is being applied to AI systems across operations. Examiners are asking whether AI tools used in customer service, fraud detection, and collections have gone through the same validation and documentation process as underwriting models. Many have not.

HIPAA enforcement is evolving to address AI systems that handle protected health information. The question is no longer just whether PHI is stored securely. It is whether the AI system that processes that information — including third-party tools connected to the EHR — has appropriate access controls, audit logging, and oversight documentation.

For Department of Defense contractors and federal agencies, the requirements are more specific still. NIST AI RMF profiles are being incorporated into procurement requirements and audit criteria, effectively making the framework a compliance obligation rather than a voluntary standard.

What Regulators Actually Want to See

Across sectors, regulators are converging on a consistent set of questions. The specifics vary, but the underlying expectations are the same.

Do you know what AI you are using? An accurate, maintained inventory is the starting point for every examination and audit interaction. If you cannot produce one, the examination does not go well regardless of what else you have in place.

Do you know who is responsible for it? Governance ownership needs to be designated and documented at the system level, not just at the program level. Examiners want to know who approved the tool, who monitors it, and who gets called when something goes wrong.

Can you demonstrate oversight? For high-risk systems — those involved in credit, employment, clinical, or financial decisions — regulators expect evidence that a human is reviewing outcomes, that the system is being monitored for drift or bias, and that there is a process for handling errors and complaints.

How are you managing vendor AI? This is the question most compliance programs are not ready for. Third-party tools connected to your systems are part of your AI footprint from a regulatory standpoint. Your vendor management program needs to extend to AI capabilities embedded in the software you already use.

What This Means for Your Program

The organizations that are in the best position right now are not the ones that waited for a single federal standard. They are the ones that built programs flexible enough to map to multiple regulatory frameworks simultaneously.

That means starting with a complete AI inventory — not a list of IT-approved tools, but a real picture of what is deployed across the business. Marketing tools, HR platforms, customer service software, financial planning applications. Any tool with AI capability that touches company data or customer decisions is in scope from a regulatory standpoint.

It means building governance that operates at the system level, not just the policy level. A policy that says AI must be used responsibly is not a governance program. A governance program has owners, intake processes, review criteria, monitoring cadences, and audit trails at the individual system level.

And it means accepting that the regulatory environment is not going to consolidate into a single standard in the near term. The programs that hold up are the ones designed to demonstrate accountability across multiple frameworks, not optimized for one.

The Cost of Waiting

The argument for waiting was always that building a governance program against a moving regulatory target is inefficient. That argument made more sense in 2023 than it does in 2026.

Sector regulators are examining now. State laws are in effect now. The enforcement actions that were theoretical two years ago are happening. And the organizations that built programs early — even imperfect ones — are in a substantially better position than the ones that waited for clarity that is not coming.

If your program is not current, the answer is not a comprehensive overhaul. The answer is a gap assessment against the regulatory frameworks that are actually applicable to your organization, followed by a prioritized remediation plan that addresses the highest-exposure items first.

That is a 4 to 6 week exercise for most organizations. It is not the 6-month initiative compliance teams often imagine it to be.
